Types of Bankruptcy

- Chapter 7 – a fresh start. The debtor receives a discharge of all dischargeable debts in a Chapter 7 bankruptcy. Non-exempt property may be liquidated. It is critical to work with an experienced Chapter 7 Bankruptcy Attorney to maximize your exemptions and minimize the risk of any assets being liquidated.
- Chapter 13 – a reorganization bankruptcy. Filed by people who want to stop foreclosure, stop repossession, pay back taxes, keep their non-exempt property, or are required to pay back a portion of their unsecured debt based on their disposable income.
